Car wash sued by man who drove into uncovered drain hole

GRETNA – A St. John the Baptist Parish man is suing a Jefferson Parish car wash after he drove into an open drainage hole, which resulted in damage to his vehicle and injuries to him and his daughter.

Charlie Taylor, individually and on behalf of his minor child, filed suit against Colony Specialty Insurance Company and Harahan Car Wash in the 24th Judicial District Court on March. 18.

Taylor claims he was driving his vehicle with his daughter as a passenger at Harahan Car Wash located at 3240 Georgia Ave. in Harahan when his vehicle dropped into an uncovered drain hole. The plaintiff alleges that his car was damaged in the incident and that both he and his daughter suffered personal injuries. Taylor assert that he received neck, shoulder and back injuries and that his daughter received neck and head injuries in the incident.

The defendant is accused of failing to maintain the premises, failing to remedy an unreasonably dangerous condition and failing to warn patrons of the unreasonably dangerous condition.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, medical expenses, lost wages, loss of earning capacity, property damage, loss of use of vehicle and rental car expenses.

Taylor is represented by W. Suzanne Montero of New Orleans-based Law Offices of Warren A. Forstall Jr.

The case has been assigned to Division F Judge Michael P. Mentz.
