Linen service sues restaurant for canceling contract

GRETNA – A Jefferson Parish laundry service is suing a Pass Christian, Miss. restaurant for allegedly breaking a five year contract.

Loop Linen Service Inc. filed suit against Cassandra Timmons and Joseph O. Schuman, on behalf of Old Cuevas Bistro, in the 24th Judicial District Court on March. 21.

The plaintiff alleges that on Jan. 14, 2013, the defendants discontinued the service. Loop Linen Service Inc. asserts that under the contract the cancelation of services granted them a right to an 80 percent fee of average weekly charges for the remainder of the agreement. The plaintiff claims it is owed $30,702.52 for the remaining 244 weeks of the contract.

Damages in the amount of  $32,455.86 for all fees remaining on the contract in addition to past due payments and the cost of items allegedly not returned are requested by the plaintiff.

Loop Linen Service Inc. is represented by Michael S. Futrell of Metairie-based Connick and Connick LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
