Baton Rouge Police Department employee sues for injuries allegedly caused by file cabinet

BATON ROUGE – A Baton Rouge City Police Department employee working in the traffic records file room is suing the City of Baton Rouge and several related entities claiming she was injured when a filing cabinet tipped over and landed on top of her.

Jennifer Nicole Zoghbi filed a lawsuit against Global Industries of N.J., Dwayne White, The City of Baton Rouge, The Baton Rouge City Police Department, Parish of East Baton Rouge and each of their insurers in the 19th Judicial District Court on Feb. 22.

The plaintiff claims that while operating in her capacity as an employee in the traffic records room in the B.R.P.D she opened a file cabinet drawer and the cabinet toppled over and landed on top of her.  Zoghbi says the incident resulted in a closed head injury, a fractured hip, lumbar spine injury, hearing loss, difficulty breathing, partial paralysis, seizures, abrasions and contusions and various muscle strains and sprains.

The defendants are accused of failing to properly manufacture and design the filing cabinet to prevent tipping over during the course of its intended, ordinary and expected use, failure to properly install, maintain and secure the filing cabinet and failing to warn plaintiff of the defective condition of the cabinet.

An unspecified amount is sought for all damages including lost wages, medical expenses and loss of earning capacity.

The plaintiff is represented by Michael C. Palmintier of Baton Rouge-based deGravelles, Palmintier, Holthaus & Fruge LLP.

This case has been assigned to Section 23 Judge William A. Morvant.
