Subcontractor sues Jefferson Parish contractor for non-payment of nearly $40K

Breach of contract

GRETNA – A subcontractor on a Jefferson Parish facility is suing the parish’s main contractor on the project for unpaid amounts under their contract.

Apex Building Technologies Group Inc. filed suit against Catco General Contractors LLC and Hanover Insurance Co. in the 24th Judicial District Court on April 12.

Apex Building Technologies Group claims they entered into a contract with Catco to provide construction services on the new East Bank Maintenance Facility Project with Hanover providing a surety bond guaranteeing payment.

The plaintiff alleges they completed all work on the project on Dec. 1, 2009, but out of the $464,260.14 they were owed they were only paid $426,075.95–a difference of $39,184.19. Apex Building Technologies Group asserts that they still remain unpaid despite making a request on Hanover as well as Catco.

The defendant is accused of breach of contract.

Damages in the amount of $39,184.19 plus attorney’s fees, court costs and penalties are sought.

The case has been assigned to Division H Judge Glenn B. Ansardi.
