Hooters sued by woman claiming permanent disability after falling on soapy restroom floor

GRETNA – A Plaquemines Parish woman is suing a restaurant chain for injuries  received serious and disabling injuries in a fall in the women’s restroom.

Shelly E. Chiappetta filed suit against Hooters of Louisiana LLC; Gibson, Greco & Wood Ltd., Blue Sky management Company LLC and Republic Underwriters Insurance Company in the 24th Judicial District Court on April 23.

Chiappetta claims she was a customer at the Hooters restaurant located at 4748 Veterans Blvd. in Metairie when she slipped on a freshly mopped wet and soapy floor in the women’s bathroom. The plaintiff alleges that no signs were in place to warn of the hazardous condition of the floor. Chiappetta asserts she received injuries to her head, neck, back, shoulders, jaw and spine.

The defendant is accused of failing to maintain the store in a prudent manner, failing to take proper precautions to keep the bathroom floors clean and free from foreign objects, creating an unreasonable risk of harm, creating a hazardous situation by mopping the bathroom floor, failing to place warnings signs, failing to exercise reasonable care, allowing a foreign soapy substance to remain on the bathroom floors and negligently supervising and training employees.

An unspecified amount in damages is sought for medical expenses, lost wages, loss of earning capacity, pain and suffering, permanent disability, mental anguish, loss of enjoyment of life, lost wages and loss of future earning capacity.

Chiappetta is represented by Dean J. Favret of New Orleans-based Favret, Demarest, Russo & Lutkewitte.

The case has been assigned to Division J Judge Stephen C. Grefer.
