Woman claims disability after falling in Shell gas station parking lot

GRETNA – A Jefferson Parish woman is suing a gas station where she claims to have been injured in a fall on an incline in a gas station parking lot.

Lillian E. Alexie filed suit against Danish Inc. in the 24th Judicial District Court on May 17.

She claims that on May 17, 2012 she was at the Shell gas station located at 101 West Bank Expressway in Gretna when she tripped and fell on uneven pavement on an incline in the parking lot. The plaintiff alleges that emergency medical technicians were dispatched to the scene and that when they arrived she was injured and bleeding badly and was diagnosed with a broken finger, bruised ribs, contusions and hip and shoulder injuries.

The defendant is accused of failing to warn of an uneven ground surface, constructing and maintaining the uneven ground surface, failing to properly maintain the area were patrons were invited to walk, failing to properly maintain the area, being in control of the hazardous area and inviting patrons to walk in the area knowing of the defect.

An unspecified amount in damages is sought for pain and suffering, medical expenses, permanent disability, loss of enjoyment of life and family, emotional distress, depression, permanent scarring and all injuries.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
