NEW ORLEANS - A patient is suing a nursing home after allegedly being dropped twice by staff.
Jose Jorge Gonzales filed a suit against the New Orleans Home for the Incurables in the Orleans Central District Court on May 19.
The suit claims Gonzales, a "high risk" quadriplegic, was dropped on two different occasions while being transferred from his bed to a wheelchair.
After his first fall in Aug. 25, 2011, X-rays revealed he had suffered a broken leg. On Sept. 1, 2011, he was allegedly dropped again while being transferred by staff who were using a lifter hoist. It was later discovered the fall injured his coccyx region and lower back.
The defendant is accused of neglect for dropping a patient, failing to maintain a safe environment and failing to maintain proper equipment.
Damages in an unspecified amount are sought for prolonged pain and suffering, mental anguish and medical expenses.
The plaintiff is represented by Lawrence J. Centola III of the New Orleans-based Martzell & Bickford.
The case has been assigned to Division G Judge Robin M. Giarrusso.
