Health insurance agency sued by insurer for not providing commissions

GRETNA – A Louisiana-based insurance company is suing an insurance agent for allegedly taking payments for insurance, but not forwarding them on to the insurance company.

LAMMICO Insurance Agency Inc. filed suit against Don Cousins & Associates Inc. in the 24th Judicial District Court on June 20.

LAMMICO Insurance Agency Inc. claims that they provided Don Cousins & Associates names of physicians and clinics so they could attempt to sell life, health, disability and dental insurance policies to physicians and clinics. The plaintiff alleges that the defendant was supposed to provide them with notice that he was contacting people on the list and that he was to pay them 33 percent of any commission on sales.

LAMMICO asserts that from 2006 to 2012 Cousins & Associates Inc. sold insurance under this contract but that in 2012 they began to no longer pay commissions. The plaintiff claims they are owed thousands of dollars in commissions.

The defendant is accused of breach of contract.

Damages in the amount of $31,788 is sought for commissions that have allegedly not been paid.

LAMMICO Insurance Agency Inc. is represented by Maryann G. Hoskins of New Orleans-based Degan, Blanchard & Nash.

The case has been assigned to Division E Judge John J. Molaison Jr.
