Kenner tobacco shop sued by wholesaler for alleged non-payment for $65K worth of goods

GRETNA – A tobacco shop is being sued by a Harvey-based wholesaler for alleged non-payment for goods.

Frank Silva and Sons LLC filed suit against Fabcos LLC, Payless Cigarettes and Jesse F. Acosta in the 24th Judicial District Court on June 27.

Frank Silva and Sons LLC claims that they delivered goods to Fabcos LLC, Payless Cigarettes and Jesse F. Acosta through their wholesale distribution company. The plaintiffs allege that despite the defendants ordering the goods from them, which the delivered they were never paid. Frank Silva and Sons LLC asserts they are owed $65,958.34 by the defendants for which they have provided written notice, but have not had any response.

The defendant is accused of breach of contract.

Damages in the amount of $65,958.34 plus attorney’s fees are sough by the plaintiff.

Frank Silva and Sons LLC is represented by Kevin R. Truxillo of New Orleans-based Garrison, Yount, Forte, Mulcahy & Lehner LLC.

The case has been assigned to Division C Judge June Berry Darensburg.
