Motiva refinery worker sues after slipping and falling in puddle of liquid

NEW ORLEANS - A Motiva refinery worker has filed a lawsuit claiming he suffered injuries when he slipped and fell in a puddle of liquid.

Colby Dixon filed suit against Motiva Enterprises, David G. Brignac, and ABC Insurance on July 10 in St. James Parish District Court. The defendants removed the case to federal court in New Orleans on Aug. 14.

The alleged incident occurred on Oct. 10, 2012 as Dixon was working for ISC Constructors at the Motiva Enterprises’ Convent Refinery. Dixon states he stepped in a puddle of liquid and slipped and fell. According to the lawsuit, Dixon later observed that the liquid was emanating from a broken pipe.

The defendants are accused of negligence for failing to maintain a reasonable safe area for its patrons, failing to provide immediate assistance to Dixon, failing to train Dixon, failing to warn, reckless endangerment, reckless indifference, allowing a substance to remain on the ground and endanger patrons, failing to preserve evidence, failing to properly interview all witnesses, failing to preserve all video evidence, failing to correct a leaking pipe, failing to place warning signs around the leaking pipe, and for failing to adequately warn Dixon of the leaking pipe.

The plaintiff is seeking an award of damages for loss of enjoyment of life, physical disability, pain and suffering, mental pain and suffering, disruption of bodily tissues and cells, medical expenses, lost wages, court costs, and attorney’s fees.

Dixon is represented by Ron A. Austin and Jeffrey P. Green of Ron Austin & Associates, LLC in Harvey.

U.S. District Judge Jay C. Zainey is assigned to the case.
