Sushi restaurant sued for allegedly breaching lease contract

GRETNA – A local sushi restaurant is being sued by its former landlord for allegedly breaching a commercial lease contract.

Lin’s Property LLC filed suit against Sakura New Oeleans Inc. and Calvin Cuong Nguyen in the 24th Judicial District Court on July 1.

Lin’s Property LLC claims that Sakura New Orleans Inc. and Nguyen leased a commercial property from them located at 3525 Williams Blvd. in Kenner. The plaintiff alleges that the agreement was made on Jan. 31, 2011 at $8,000 per month for a period of three years. Lin’s Property LLC asserts that Sakura agreed to provide multi-peril, flood, commercial liability and worker’s compensation insurance. The plaintiff claims that the defendant did not procure the required flood and hazard insurance and they as the property owners were forced to provide the insurance at a cost of $73,326.76. Lin’s Property LLC alleges that they sent a notice to Sakura that they were to be evicted due to noncompliance with the lease.

The defendant is accused of not taking steps to cure the defaults, failing to take steps to carry required insurance and breach of lease.

An unspecified amount in damages is sought for the remaining balance on the lease for rent, amounts for past due rent and attorney’s fees.

Lin’s Property LLC is represented by Robert S. Stassi of New Orleans-based Carver, Darden, Koretzky, Tessier, Finn, Blossman & Areaux LLC.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
