Woman who tripped over soda sues Pepsi and CVS Pharmacy

GRETNA – An international beverage company and a local pharmacy are being sued by a woman who claims to have tripped over a case of soda.

Margaret Venezia filed suit against CVS Pharmacy Inc., Pepsico Inc. and their insurers in the 24th Judicial District Court on July 2.

Venezia claims that she was walking in the aisle of the CVS Pharmacy located at 820 W. Esplanade Ave. in Metairie when she tripped over a Pepsi product and fell to the floor. The plaintiff alleges that the soda was improperly stored and that she received injuries to her leg, back, neck, head and feet.

The defendant is accused of creating a hazardous condition, failing to properly train employees on cleaning and maintenance of premises, failing to properly place products causing a hazard and failing to warn customers of the hazardous and defective nature of the premises and careless and reckless natures of the products being placed, according to the suit.

An unspecified amount in damages is sought for mental anguish, embarrassment, humiliation, medical expenses, pain and suffering and damage to petitioner’s clothing.

Venezia is represented by attorney Paolo J. Messina of Baton Rouge.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
