GRETNA – A Jefferson Parish woman who is believed to be deceased is being sued by a landlord that owns property next to hers and claims a tree on the property has destroyed a wall dividing the two properties.
Highland Oaks Properties LLC filed suit against Carol Edwin Hartley in the 24th Judicial District Court on July 3.
Highland Oaks Properties claims that although they believe their next door neighbor Hartley is deceased, a tree on her property is responsible for the destruction of a brick wall they own that divides the two properties. The plaintiff alleges the defendant’s property at 54 Oakland St. in Harahan is trespassing on their property which has resulted in the wall being damaged. Highland Oaks Properties asserts that no succession has been established for Hartley thus they have named her person in the filing.
The defendant is accused of trespass.
An unspecified amount in damages is sought for an injunction requiring the destruction of the tree.
