GRETNA – An Arkansas woman who allegedly injured herself in a fall when exiting a local restaurant is suing.

Diane Maxwell filed suit against Da Metry Store LLC and Acme Oyster House in the 24th Judicial District Court on July 9. 

Maxwell claims she was exiting the Acme Oyster House located at 300 Veterans Blvd. in Metairie when she tripped and fell to the ground. The plaintiff alleges that her fall was due to poor lighting in the area of the establishment’s stairs. Maxwell asserts she received serious injuries to her knees and foot in the fall.

The defendant is accused of failing to properly inspect the area, failing to properly maintain and inspect the premises, failing to properly mark or paint the steps, failing to use reasonable and prudent care, failing to warn of an unreasonable condition and improper lighting.

Damages in excess of $50,000 are sought for physical pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, lost wages and loss of earning capacity.

Maxwell is represented by A.J. Rebennack of Metairie.

The case has been assigned to Division C Judge June Berry Darensburg.
