GRETNA – A Jefferson Parish man is suing the owner of a local urgent care center and a wound care center that he was referred to after a small cut he got on his foot turned into a severe infection that left him hospitalized and in treatment for weeks.

Terry Kelly filed suit against CPP Holdings LLC, CPP Wound Care #12 LLC and Louisiana Wound Care Specialists in the 24th Judicial District Court on July 26.

Kelly, an insulin dependent diabetic, claims he stepped on a piece of glass on May 4, 2012 and the following day showed up at Doctors After Hours Urgent Care & Walk In Clinic-Clearview where a doctor removed the glass. The plaintiff alleges that urgent care center should have forwarded orders for further treatment on to Louisiana Wound Care Specialists, but when he contacted them the next day they told him the orders had not been forwarded.

Kelly asserts that the next day he contacted the urgent care and asked again to forward orders to the wound care center and was told again they had not received the orders. The plaintiff claims that two days later he entered the hospital where it was found he had a massive infection in his foot and had to hospitalized for five days, received IV treatment for six weeks and underwent 40 hyperbaric treatments before he was released from care.

The defendant is accused of failing to timely follow up on the plaintiff’s care, failing to expedite initiation of wound care and failing to recommend the plaintiff to another wound care treatment provider so as to begin wound treatment sooner.

An unspecified amount in damages is sought for pain and suffering, medical expenses, fear of recurrence of osteomyelitis, loss of income, loss of enjoyment of life and mental suffering.

The case has been assigned to Division F Judge Michael P. Mentz.
