GRETNA – A Metairie Winn Dixie grocery store was sued twice on the same day for slip and fall incidents that allegedly occurred in back to back days in August 2012.
Dana LaFleur filed suit against Winn-Dixie Stores Inc., Bi-Lo Holdings LLC, Winn-Dixie Properties LLC, Winn-Dixie Montgomery LLC and Bi-Lo Holdings Foundation Inc.
Julia Hagar filed suit against Winn-Dixie Montgomery LLC and its insurer.
Both suits were filed in 24th Judicial District Court on Aug. 9.
The claims concern two slip and fall incidents that allegedly occurred at the Winn-Dixie located at 5901 Airline Drive in Metairie on Aug. 10 and 11, 2012.
First, on Aug. 10, LaFleur claims she slipped and fell to the floor due to a frozen food cooler, refrigerator of other equipment leaking water.
LaFleur alleges she was seriously injured in the incident due to the defendant’s negligence including knowing the hazard existed, allowing the danger to exist and not warning of the hazard.
A day later on Aug. 11, Hagar claims she was walking in the soda aisle when she slipped on a liquid substance and fell to the floor.
Hagar alleges she was injured in the fall that was caused by the defendant’s failure to adequately inspect the area, failure to warn of the danger, failure to repair the defect, failure to provide a safe and hazard free environment, failure to adequately remedy the dangerous condition and failure to provide adequate lighting in the are of the fall.
LaFleur is seeking an unspecified amount in damages for pain and suffering, mental anguish, loss of life’s pleasures, loss of consortium, enhancement of disabilities, wage loss and loss of earning capacity.
Hagar is seeking an unspecified amount in damages for physical pain and suffering, mental pain and suffering, mental anguish, physical impairment, disability, medical expenses, rehabilitation expenses, loss of services, loss of society and loss of enjoyment of life.
