Burlington Coat Factory sued by woman who claims injury after shelf allegedly fell on her

GRETNA – A corporate clothing retailer is being sued by a woman who claims she was injured when a shelf fell on her at one of their local stores.

Ebony Dixon filed suit against Burlington Coat Factory of Louisiana LLC and Zurich American Insurance Co. in the 24th Judicial District Court on Aug. 21.

Dixon claims she was a customer at the Burlington Coat factory located at 3324 Williams Blvd. in Kenner on Dec. 12, 2012. The plaintiff alleges that as she was standing near the cashier’s counter an employee pushed a cart into a shelf that then fell onto her forearm. Dixon asserts she was severely injured in the incident.

The defendant is accused of failing to maintain a proper lookout, failing to take precautions necessary to create a safe environment and allowing an employee to use a rolling cart without proper training.

An unspecified amount in damages is sought for medical expenses, mental anguish, pain and suffering, wage loss, loss of enjoyment of life and loss of earning capacity.

Dixon is represented by James S. Rees Jr. of the Metairie-based Charbonnet Law Firm.

The case has been assigned to Division E Judge John J. Molaison Jr.
