Uncovered water meter hole leads to lawsuit

NEW ORLEANS—A woman who allegedly fell in an uncovered water meter hole while walking seeks compensation for her injuries.

Cheryl Cheneau filed suit against the Sewerage and Water Board of New Orleans in the Orleans Parish Civil District Court on July 19.

The plaintiff claims that her right foot landed in an uncovered water meter hole while she was walking down Canal Street last September, causing her to fall. A description of Cheneau’s injuries in the suit includes acute cervical and lumbosacral strain, bilateral pain and strain of shoulders, bilateral hip pain and occipital headaches and dizziness.

The defendant is accused of negligence for failing to secure the metal top to the hole, failing to surround the open hole with a barricade for safety purposes and failing to institute proper inspection procedure to protect and warn pedestrians.

An undisclosed amount in damages is sought for medical expenses, lost wages and earning capacity, pain and suffering, emotional stress and strain, permanent residual disability and loss of enjoyment of life.

The plaintiff is represented by Darleen M. Jacobs of New Orleans-based Jacobs, Sarrat, Lovelace & Harris.

The case has been assigned to Division G Judge Robin M. Giarrusso.
