Rouse’s sued by woman who claims injury in trip on construction debris

GRETNA – A grocery store chain is being sued by a woman who claims to have inured herself after tripping on construction debris.

Joann Barden filed suit against Rouse’s Enterprises LLC and Columbia Casualty Company in the 24th Judicial District Court on Sept. 4.

Barden claims that on March 22 she was shopping at the Rouse’s grocery store located at 2851 Belle Chasse Highway in Gretna when she tripped and fell on construction debris located on the sales floor. The plaintiff alleges the refuse was negligently allowed to accumulate on the floor and led to her injuries.

The defendant is accused of failing to inspect and maintain the defective area, failing to timely inspect and clean up construction areas of the supermarket, failing to warn customers of the danger, failing to safely maintain the area in a reasonably safe condition, creating or maintaining a dangerous condition, creating and maintain an unreasonable risk of harm and allowing a dangerous condition to exist.

An unspecified amount in damages is sought for pain and suffering, permanent damage, loss of enjoyment of life and medical expenses.

Barden is represented by attorney Pierre F. Gaudin of Gretna.

The case has been assigned to Division I Judge Nancy A. Miller.
