NEW ORLEANS – A couple is suing a construction company for breach of contract and fraudulent billing on their home renovation project.

Kevin Hudson and Yakaira Nunez filed suit against Harry Lucas Development LLC and Harry Lucas in the Orleans Parish Civil District Court on Aug. 14.

The plaintiffs claim that the defendants breached the construction contract entered into by both parties by charging numerous overages outside the negotiated price of $18,500. Hudson and Nunez allege that they were forced to purchase materials and supplies to complete the project in a timely manner while expecting credit for the overages of approximately $750 to be applied to their last scheduled payment.

In addition, the defendants are accused of incomplete and inadequate work including defective and/or incomplete work on the home's doors, crown moulding, attic ladder, utility room foundation, trim, front porch, concrete walkway, shelving, closets, mantle, counters, flooring and windows in various rooms. The plaintiffs allege that Harry Lucas intentionally misrepresented his work, resulting in the plaintiffs’ loss of enjoyment, use and dominion over their property.

An unspecified amount is sought for damages incurred by Hudson and Nunez in the renovation of their home to include any relief, legal interest, attorneys’ fees and costs of the proceedings.

The plaintiffs are represented by William Ramsey of Ramsey Law Firm LLC.

The case has been assigned to Division M Judge Paulette R. Irons.
