NEW ORLEANS – A man alleges that he slipped and fell at a New Orleans office building while walking down a flight of stairs.
Floyd Miles, Sr. filed suit against the Louisiana State Department of Transportation & Development and Crescent City Connection, a Division of the State of Louisiana, in the Orleans Parish Civil District Court.
The plaintiff claims he was injured when he slipped in a puddle of water that had accumulated on a step at the Crescent City Connection office building. He alleges that he then fell down the stairs on his back, injuring his head, neck, shoulders, his arm and thumb.
The defendant is accused of creating an unreasonable risk of harm by failing to inspect, discover, fix and warn visitors of the defective conditions.
As a result of his alleged injuries, the plaintiff claims that he has been forced to discontinue playing golf and gardening, two of his beloved hobbies. Miles says he has also received treatment from a general practitioner, orthopedist, ophthalmologist, physical therapist, radiologist, and pain specialist for his health problems.
An unspecified amount in damages is sought for the plaintiff’s medical expenses to treat incident-related damage to cervical spine and spinal cord, vision impairment and loss, weakness in upper extremities, head trauma, pain and suffering, mental anguish and distress, loss of enjoyment of life and disability.
The plaintiff is represented by Joseph E. Cain and Aaron Ahlquist of New Orleans-based Herman, Herman and Katz LLC.
The case has been assigned to Division H Judge Michael G. Bagneris.
