NEW ORLEANS – A couple filed suit against Ochsner Medical Center after the wife slipped and fell while on the premises.
Irma J. Wilson and her husband, Curtis Wilson, filed suit against Ochsner Medical Center – Northshore LLC in the Orleans Parish Civil District Court.
The suit states that on Oct. 31, 2012, Irma Wilson was at the Ochsner Health Center on O’Neal Lane in Baton Rouge, where she slipped, her right knee came out from under her, and she fell into a split position hitting her knee and landing on her left buttock.
The area was allegedly slick due to floor wax that permitted an unreasonable dangerous condition to exist, the suit claims.
Ochsner is accused of failing to maintain the premises in a reasonably safe condition, failing to place adequate warning signs and being otherwise negligent.
The plaintiffs seek an unspecified amount in damages for loss of and/or damage to enjoyment of life, physical pain, mental pain, medical expenses, loss of earnings, diminished earning capacity, disfigurement, physical disability, and emotional problems and psychological problems. Irma Wilson’s husband, Curtis Wilson, is also suing for loss of consortium.
The plaintiffs are represented by Ron S. Macaluso of Ron S. Macaluso Law Firm LLC in Hammond.
The case has been assigned to Division L Judge Kern A. Reese.
Case no 2013-8130.
