Dispute over plumbing and mechanical work on hotel repair project subject of suit

NEW ORLEANS – A New Orleans contracting company is suing its subcontractor for breach of contract in connection with repairs performed on a local hotel.

H & O Investments LLC filed suit against AA Gouner Plumbing & Mechanical Inc. (AAG) and Certain Underwriters at Lloyd’s London in the Orleans Parish Civil District Court on Aug. 16.

The plaintiff contractor claims that its contract with the defendant subcontractor to perform services for The Indigo Hotel, formerly known as the Garden District Hotel, on St. Charles Street was breached and that the work was not completed in a timely manner.

AAG is also accused of lacking proper licensure and abandoning its obligations as outlined in the contract.

H & O claims that upon inspecting AAG’s work, it found “numerous and substantial deviations from the specifications for construction of the building” including installation of improper piping and faulty connection of water supply lines. According to the plaintiff’s case, AAG failed to make corrections to fix defective work pursuant to a 48-hour cure notice issued by H & O. As a result, the plaintiff claims making emergency repairs and replacements of pumps, piping, electrical wiring, sheetrock and ceilings in several hotel rooms was necessary.

An unspecified amount in damages is sought for negligence in improper staffing and supervision, improper installation, noncompliance with job specifications, performing work in an unworkmanlike manner, providing defective materials, failing to recognize defects in their work and not rectifying those defects. The plaintiff is asking for the cost of labor and materials for remedial work, delay, liquidated damages and attorney’s costs and fees.

The case has been assigned to Division I Judge Piper D. Griffin.
