Woman sues Walgreens for $50K over aisle segment collapse

NEW ORLEANS – A woman has filed suit against Walgreens after a segment of an aisle allegedly fell on her while she was shopping.

Mary Watts filed suit against Walgreen Louisiana Co. Inc. in the Orleans Parish Civil District Court.

The suit states that on Sept. 8, 2012, the plaintiff was shopping in the cold and flu aisle of Walgreens, when an unattached shelf that was leaning in the aisle fell over, stuck the plaintiff, and caused injuries to her mind and body.

Walgreens is accused of negligently repairing and/or restocking merchandise while its customers are present, failing to remove a known hazard from the aisle, failing to keep the aisle clear and unobstructed and being otherwise negligent.

The plaintiff seeks $50,000 in damages for medical expenses, fright, fear, mental anguish, physical pain and suffering and loss of enjoyment of life’s pleasures.

The plaintiff is represented by Jonathan P. Friedman of Silbert, Garon, Pitre & Friedman of New Orleans.

The case has been assigned to Division A Judge Tiffany G. Chase.

Case no. 2013-8158.
