NEW ORLEANS – A construction worker is suing his employer for injuries he claims he sustained after falling off unsafe and unsecure scaffolding.
Jeremy Lafontaine filed suit against Woodward Design and Build LLC, their subcontractors and insurance companies in the Orleans Parish Civil District Court on Sept. 3.
The plaintiff claims that he was injured when he fell through a wide gap in the third level scaffolding boards while installing material at the National World War II Museum.
The defendants are accused of breach of legal duties for negligence for failing to make a reasonably safe workplace, failure to properly supervise and remedy the problem, allowing the unsecure and unsafe scaffolding to persist, failing to ensure scaffolding was properly used and secured, failure to provide reasonable vigilance, failing to properly train employees on safety protocol and failing to obey parish and/or state laws.
An undisclosed amount in damages is sought for medical expenses, physical pain and suffering, mental anguish and emotional distress, loss of wages and benefits, loss of enjoyment of life, disability and physical impairments.
The plaintiff is represented by Richard Tonry of New Orleans-based Tonry, Brinson & Glorioso LLC.
The case has been assigned to Division G Judge Robin M. Giarrusso.
