Woman sues after tripping over lid in parking lot pavement

GRETNA – A woman who tripped over a lid, similar to a manhole cover, in a parking lot and fell to the ground is suing.

Vicki M. Scallan filed suit against Rault Resources Inc., Mercy Family Center and their insurers in the 24th Judicial District Court on Oct. 15.

Scallan alleges that she was walking across a parking lot when she tripped over a lid in the pavement that was covering a hole below and fell. The plaintiff asserts that she received several injuries in the fall including to her shoulder, leg, knees and a broken nose. Scallan claims that the defendant must have known that the lid was unsafe because it was painted bright yellow after her incident.

The defendant is accused of allowing a parking lot to remain in an unsafe and risky condition, creating the condition of the parking lot by not removing of calling attention to the cover, having actual notice of the condition and failing to correct it and failing to exercise reasonable care.

An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish, loss of enjoyment of life, loss of wage and income and permanent disability.

The case has been assigned to Division O Judge Ross P. LaDart.
