NEW ORLEANS – The New Orleans Housing Authority is suing Cypress Realty over allegedly faulty construction work.
The suit, filed in the Orleans Parish Civil District Court,states that on June 16, 2009, the two parties entered into a developer services agreement for construction of Fischer HOPE VI project on Landry Drive in New Orleans. Under the terms of the agreement, Cypress obligated itself to constructing and developing a housing complex consisting of “Katrina Cottages,” the suit claims.
The defendant is accused of failing to deliver a lien fee project, failing to indemnify and defend the plaintiff against all claims, liens, and suits, poorly constructing units in the project such that they failed to meet the standards required by the U.S. Department of Housing and Urban Development and failing to use quality materials in construction.
The defendant was allegedly made aware of the poor craftsmanship and given the opportunity to correct the specific defects, but did not do so.
The plaintiff seeks damages in the form of $250 per day for each day the project was not completed beyond the contract period, expenses for defending any and all claims that have arisen from the plaintiff’s failure to perform under the DSA, expenses for correcting and repairing the poorly constructed unites, completion of all punch list items, completion of all warranty work, and attorneys’ fees and expenses.
The plaintiff is represented by Brandon J. DeCuir of New Orleans-based Decuir, Clark & Adams.
The case has been assigned to Division I Judge Piper D. Griffin.
