Employer of woman run over sues driver for workers' compensation fees

GRETNA – The driver of a vehicle that ran over an on-duty employee at East Jefferson General Hospital is being sued by the hospital for workers' compensation fees.

Jefferson Parish Hospital Service District Number Two, Parish of Jefferson State of Louisiana and East Jefferson General Hospital filed suit against Denise Whelan and State Farm Insurance Company in the 24th Judicial District Court on Nov. 5.

East Jefferson General Hospital claims that on Nov. 7, 2012 Whelan ran over Deion Gray, an employee of East Jefferson General Hospital, while she was walking through the hospital’s parking garage. The plaintiff alleges that Gray was thrown to the ground and received neck and back injuries in the accident. East Jefferson General Hospital asserts that due to the injuries Gray received workers' compensation benefits as well as other fees due to the incident.

The defendant is accused of being at fault for the plaintiff's injuries and failing to safely drive through the garage.

An unspecified amount in damages is sought for workers compensation benefits, medical benefits, medical bill review fees and other expenses.

The plaintiffs are represented by Jeffrey D. Martiny of Metairie-based Chehardy, Sherman, Ellis, Murray, Recile, Griffith, Stakelum & Hayes LLP.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
