NEW ORLEANS - A Jefferson Parish woman has filed a lawsuit claiming she suffered injuries after she slipped and fell in Sprite at a Kenner grocery store.
Rebeca Rivera-Galeano filed suit against Jane Doe, Coca-Cola Refreshments d/b/a Louisiana Coca-Cola Bottling Co. and ABC Insurance Co. in Jefferson Parish District Court. The defendants removed the case to federal court in New Orleans on Nov. 21.
Rivera-Galeano claims she was injured on Sept. 12, 2012 at a Winn-Dixie. According to the lawsuit, she was walking down the drink aisle when an employee of Coca-Cola dropped a 2 liter bottle of Sprite that burst and caused Rivera-Galeano to slip and fall.
The defendants are accused of negligence for failing to keep a proper lookout, ahead or laterally, by the exercise of ordinary care, inattentiveness, careless handling, failing to see what she should have seen and for creating an unreasonable risk of harm.
The plaintiff is seeking an award of damages for medical expenses, mental anguish, inconvenience, pain and suffering, loss of enjoyment of life and service to society, lost wages, interest, attorney’s fees, and court costs.
Rivera-Galeano is represented by Miguel A. Elias, Christopher D. Weddle, Paula J. Rodriguez, Pamela C. McLendon, and Paul A. Deas of Law Office of Miguel A. Elias in Kenner.
U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
