Contractor sued by subcontractor over alleged non-payment of school project

Breach of contract

GRETNA – A subcontractor is suing the main contractor on a private school construction project for allegedly not paying for work completed. 

Mike Carson Construction Inc. filed suit against Ellis Construction Inc. and Fidelity Deposit Company of Maryland in the 24th Judicial District Court on Nov. 13.

Mike Carson Construction Inc. asserts it subcontracted with Ellis Construction Inc. to provide work on the John Curtis Christian Schools Lower Campus Education Complex. The plaintiff claims that it completed the contracted work in a professional, competent and workmanlike manner. Mike Carson Construction Inc. alleges that it is owed $82,396.17, but that amount was reduced after Ellis Construction Inc. paid $14,345.79 to its suppliers.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for the principal amount owed, penalties and attorney's fees.

Mike Carson Construction Inc. is represented by attorney Wayne J. Jablonowski of Slidell.

The case has been assigned to Division I Judge Nancy A. Miller.
