Dollar Tree store sued after patron slips on pistachios

NEW ORLEANS - A St. Tammany Parish woman has filed a lawsuit claiming she aggravated preexisting injuries when she slipped on pistachios that had been spilled on the floor.

Peggy S. Warner filed suit against Dollar Tree Stores Inc. and ABC Insurance Co. on Nov. 15 in St. Tammany Parish District Court. The defendants removed the case to federal court in New Orleans on Dec. 20.

The accident occurred on Jan. 10, 2012 as Warner entered Dollar Tree located in Covington to purchase goods. Warner slipped and fell on pistachios that had been spilled on the floor.  She suffered injuries which included aggravation to a back injury and degenerative injuries to her lumber spine.

The defendant is accused of negligent and strict liability in creating and/or neglecting the area of the spill.

The plaintiff is seeking an award of damages for medical expenses, interest, and court costs.

Warner is represented by Timothy F. Upton of The Upton Law Firm L.L.C. in Covington.

U.S. District Judge Martin L. C. Feldman is assigned to the case.
