Kenner Fire Department sued over pumper truck accident

GRETNA – A family who claims their vehicle was involved in an accident with a Kenner Fire Department pumper truck is suing.

Kirkland Sterling, individually and on behalf of his minor children, filed suit against the City of Kenner, Kenner Fire Department, Jason R. Deist, Christy A. Morales, Magali R. Morales and State Farm Mutual Automobile Insurance Company in the 24th Judicial District Court on Dec. 10.

Sterling claims he was in his truck with his three children stopped at a red light at an intersection at W. Esplanade in Kenner when a pumper truck owned by Kenner Fire Department and driven by Deist struck Christy A. Morales’s car which then spun around and struck their vehicle. The plaintiff asserts the Kenner Fire Department was responding to a call when the accident occurred and that Deist stated he did not see Morales’s vehicle before striking it. Sterling alleges he and his children were injured in the accident.

The defendant is accused of failing to see what should have been seen, disregarding the presence of other vehicles, failing to maintain a proper lookout, failing to take into account the safety of others, failing to yield, speeding, failing to have vehicle under control and failing to act as a reasonable person.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, disability, medical expenses, loss of enjoyment of life, loss of use of parts of the body, bodily disability, impairment of psychological functioning, disability from engaging in recreation, destruction of earning capacity, loss of support, loss of society and loss of consortium.

Sterling is represented by Robert B. Evans III of New Orleans-based Burgos & Evans LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
