Commercial property owner sued by man who tripped over parking bumper

GRETNA – A commercial property owner is being sued by a man who claims he was severely injured after he tripped and fell over a parking bumper while waking through a parking lot at night.

Patrick Olivier filed suit against Zurich American Insurance Company, Equity Office Properties, Inc., LA-Lakeway LLC, LA-Lakeway II LLC, LA-Lakeway III LLC, Feil Organization LLC, Lakeway Associates LLC and Lakeway Associates II LLC  in the 24th Judicial District Court on Jan. 3.

Olivier claims that on Jan. 28, 2013 he was visiting 3838 Causeway Blvd. in Metairie, which is owned by the defendants, and was walking in the parking lot at night when he tripped and fell over an unmarked parking bumper.  The plaintiff alleges that the fall was due to the parking lot being poorly lit and the parking bumper being out of place.

The defendant is accused of failing to maintain a reasonably safe place for visitors, failing to take necessary measures to protect the safety of others, failing to properly maintain the premises, failing to warn visitors of the danger, failing to provide adequate lighting and failing to take steps to avoid the incident.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, property damage, medical expenses, lost earnings, loss of earning capacity, permanent disability, loss of consortium, loss of enjoyment of life, penalties and attorney’s fees.

Olivier is represented by Anthony J. Milazzo of New Orleans-based Edward J. Womac Jr. & Associates.

The case has been assigned to Division C Judge June Berry Darensburg.
