Harahan Applebees sued by man who claims to have injured back in restroom fall

GRETNA – A restaurant chain is being sued by a man who claims he was severely injured in a slip and fall incident.

Mitchel Pasano, and wife Carol, filed suit against Southern River Restaurants LLC, Applebees Neighborhood Grill and Bar and A3H Foods in the 24th Judicial District Court on Jan. 15.

Pasano alleges that he and his wife were having dinner at the Applebee’s Neighborhood Grill and Bar located at 1220 South Clearview Parkway in Harahan on May 24, 2013 when he slipped and fell. The plaintiff asserts he was right outside the restroom area when he slipped and fell on a liquid. Pasano claims he suffered severe injuries in the incident including to his back.

The defendant is accused of failing to inspect the area, failing to warn of the dangerous situation, failing to properly maintain the floor in a proper manner, allowing a dangerous situation to exist, failing to take proper precautions and failing to have proper clean up measures in place.

An unspecified amount in damages is sought for pain and suffering, medical expenses, mental suffering, lost wages, loss of earning capacity and loss of enjoyment of life.

Pasano is represented by Jack P. Ruli Jr. of Metairie-based Gennusa, Piacun & Ruli.

The case has been assigned to Division J Judge Stephen C. Grefer.
