GRETNA – A corporate retailer is being sued by a woman who slipped in water that had accumulated in the ice cream aisle.

Stephanie Martin filed suit against Wal-Mart Sores Inc., Wal-Mart Louisiana Inc. and Claims Management Inc. in the 24th Judicial District Court on Jan. 15.

Martin alleges that on Feb. 16, 2013 she was shopping in the ice cream aisle at the Wal-Mart store located at when she slipped in water that had accumulated on the floor and fell to the ground. The plaintiff asserts that due to the incident she received severe and disabling injuries. Martin claims she received injuries to her back, right knee and hip.

The defendant is accused of failing to have appropriate policy and mechanisms in place to address the wet conditions, failing to inspect and maintain the premises, failing to observe the hazard, failing to warn of the possible danger and failing to take all reasonable care and caution.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, mental anguish, loss of earnings, loss of earning capacity, medical expenses and loss of enjoyment of life.

Martin is represented by Robert J. Caluda of the Metairie-based The Caluda Law Firm.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
