Auto dealer sued for allegedly failing to deliver a $40K Mercedes

NEW ORLEANS – A car company is being sued by a customer who claims she never received a car she purchased from them.

Richelle Cook filed suit against Worldclass Motors LLC, Joel Cutelle, Mark Ferrel, Will G. Harris, Global Financial Holdings Group Inc. and Toni Graham in the Orleans Parish Civil District Court.

Cook asserts she was guided by Harris and Ferrel, employees of Worldclass Motors, to purchase a Mercedes. According to Cook, all agreed on a price comprising the vehicle, tax, broker, and delivery fees totaling $47,570. Cook believed she had been instructed to deposit money in a Chase Bank and expected to receive a car delivery within seven days.  After the car was never delivered, Cook allegedly contacted Harris, Ferrel and Graham, the CFO/secretary of Global Financial Holdings listed as the purchase agreement’s seller, requesting a refund. Graham informed Cook that a full refund would be issued by Harris and Ferrel, but the refund never transpired, the suit claims.

Worldclass Motors, Global Financial Holdings and its listed employees are accused of breach of contract, conversion and fraud for wrongfully retaining Cook’s funds.

Cook is seeking unspecified damages for the above counts plus compensatory damages.

Cook is represented by Morris Reed Jr. of New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
