NEW ORLEANS – A local woman is suing a chain grocery store for damages related to injuries suffered in a trip and fall incident.
Lynn Victor filed suit against Winn-Dixie Montgomery LLC in the Orleans Parish Civil District Court.
The plaintiff alleges that on Jan. 1, 2013, while shopping at Winn-Dixie at 9701 Chef Menteur Highway she tripped over a stack of paper towels in the middle of the floor when she went to get a basket. Victor claims that due to the store's failure to properly maintain its premises, she received injuries to her legs, buttocks, neck, back and shoulders.
Winn Dixie is accused of failure to properly maintain its premises and failure to warn their guests of known hazardous conditions.
An unspecified amount in damages not exceeding $75,000 is sought for physical and mental pain and suffering and disability, medical expenses, loss of enjoyment of life, disability and loss of function, scarring and disfigurement.

Winn-Dixie responded to these charges on Jan. 30 alleging that there is insufficient evidence that Victor sustained any injuries on their premises. In addition, Winn-Dixie claims that, while they deny any damages were sustained, were injuries sustained they would have been due to Victor’s failure to be attentive, which they plan to show in greater detail in trial.

The case has been assigned to Division I Judge Piper D. Griffin.
