Food distributor sued for over $450K by seafood supplier

GRETNA – A local shrimper is suing a local food distribution and food technology company for allegedly providing them with bad checks for hundreds of thousands of dollars worth of seafood.

Son Tran and Tropical Seafood filed suit against Innovative Food & Biotechnology Inc., Calvin Cuong Nguyen in the 24th Judicial District Court on Feb. 12.

Tran and Tropical Seafood claims that Nguyen, on behalf of Innovative Food & Biotechnology Inc., made purchases of seafood with five checks totaling $454,064.21. Innovative Food & Biotechnology Inc. is a food processing center that in addition to providing food to local restaurants also utilizes shrimp waste in biomedical and industrial applications. Tran and Tropical Seafood allege that Innovative Food & Biotechnology Inc. allege that the defendant violated state law regarding bad checks by knowing he did not have sufficient funds to cover the amount of the checks. Tran and Tropical Seafood asserts that although they have made demands on Nguyen and Innovative Food & Biotechnology Inc. of the amount in question, they have not received reimbursement.

The defendant is accused of failing to tender payment and violating state law.

Damages for all amounts owed, attorney’s fees and legal costs is sought by the plaintiff.

Tran is represented by Harvey-based attorney Anh Quang Cao of the Cao Law Firm.

The case has been assigned to Division A Judge Raymond K. Steib Jr.
