GRETNA – A construction company is suing the daughter of a former worker who allegedly accepted a payout from her deceased father’s 401K account that was meant for her sister.

Core Construction Services LLC filed suit against Nicole Meynard in the 24th Judicial District Court on Feb. 25.

Core Construction Services LLC asserts that the defendant’s father, Alan Meynard, contributed to a 401K account during his employment until his death on Feb. 26, 2011. The plaintiff alleges it understood that Alan Meynard intended to split the amount in his 401K equally among his daughters in the event of his death and they split the proceeds of the account between Nicole Meynard and her sister Alaina Meynard. However, Core Construction Services LLC claims that after the proceeds were delivered it was discovered that Alaina Meynard was the sole beneficiary of the account and that money from the account provided to Nicole Meynard was done so mistakenly.

The plaintiff asserts that despite requests to return the money or provide it to her sister the defendant has not done so.

The defendant is accused of breach of contract and unjust enrichment.

The plaintiff seeks repayment in the case.
