Sporting goods store sued by woman who alleges injury after trip over stool

Academy sports outdoors theft

GRETNA – A local sporting goods store is being sued by a woman who alleges she was injured after tripping and falling over a wooden stool.

Oliva Macklin filed suit against Academy Louisiana Co. LLC, Academy Sports and Outdoors Ltd. and XL Specialty Insurance in the 24th Judicial District Court on March 6.

Macklin claims that on July 31 at 5 p.m. she was at the checkout lane at the Academy Sports located at 8843 Veterans Memorial Blvd. in Metairie when she tripped and fell over a wooden stool. The plaintiff alleges she was injured in the incident.

The defendant is accused of failing to maintain the premises in a safe condition, failing to have in effect adequate inspection and stocking, maintaining a condition the defendant should have known was dangerous, permitting an unsafe condition to exist and failing to warn customers of the defect.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish and medical expenses.

Macklin is represented by Steven M. Koenig of New Orleans-based Valteau, Harris, Koenig & Mayer.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
