Roofing company sued for alleged improper roof installation

GRETNA – A local homeowner is suing a roofing company for allegedly damaging her home by improperly installing a roof.

Marcia Shields filed suit against Aerial Contracting LLC in the 24th Judicial District Court on March 27.

Shields alleges she contracted with Aerial Contracting for $30,500 to provide a roof replacement on her home located at 113 Lavergne St. in New Orleans. The plaintiff asserts under the contract the defendant was to remove existing shingles, install a metal roof, chimney flashing and coating the rear roof.

Shields claims she provided a down payment of $13,500 to Aerial prior to work beginning. After the defendant had begun the work the plaintiff allegedly found the front roof was installed with the incorrect type of screws, the flashing was cut in a sloppy manner, rust was appearing on parts of the roof, a defect was found in a skylight and material was hanging from the roof.

Further, Shields alleges that an inspector found more serious defects with the roof in a Dec. 2, 2013 report. The plaintiff claims that she met with Aerial to discuss the defects found in the report to which Aerial allegedly proposed to make corrections to the problems. However, Shields asserts she was not satisfied with the defendant’s proposal and forwarded photos of the roof to the roofing product manufacturer who allegedly told her it had been improperly installed.

The defendant is accused of breach of contract, damage to property from rain entering through the roof and failing to perform according to state law.

An unspecified amount in damages is sought for removal and repair of the roof.

Shields is represented by attorney Kyle S. Scalfani of New Orleans.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
