GRETNA – A national hardware and home improvement store is being sued by the owners of a home who claim its employees improperly installed a hardwood floor in their home.
Jonathan and Lisa Comeaux filed suit against The Home Depot Inc., United States Installation Group and Bayer 1 Inc. in the 24th Judicial District Court on April 15.
The Comeauxs, who own a home located at 4824 Craig Avenue in Metairie, state they purchased hardwood flooring from the Home Depot, who contracted with United States Installation Group to install the flooring.
The plaintiffs allege that the floor was improperly installed and that the wood was not glued down, which required re-installation. The Comeauxs claim inspectors representing Home Depot assessed the floor and agreed it had been poorly installed and not properly secured with glue, according to the suit.
The plaintiffs assert that they moved out of their home for a week for the work to be redone by a different installer, Bayer 1 Inc., and when they returned they found multiple problems with the work completed.
The Comeauxs claim they had the home again inspected by the agent representing the defendants, who did not call for a re-installation.
The defendant is accused of breach of contract, breach of warranty and failing to complete the work in a workmanlike manner.
An unspecified amount in damages is sought for inconvenience, mental anguish, emotional distress, out of pocket expenses and moving expenses.
The Comeauxs are represented by Neil F. Nazareth of New Orleans-based Martzell & Bickford.
The case has been assigned to Division J Judge Stephen C. Grefer.
