GRETNA – A construction company working on a pumping station in Jefferson Parish is suing a subcontractor who charged for an extra month for which they allegedly did not provide work on the project.
Merrick Construction LLC filed suit against Associated Pump & Supply LLC in the 24th Judicial District Court on April 17.
Merrick Construction claims it was the main contractor on the construction of the Lake Cataouatche Pumping Stations No. 1 and 2 in Jefferson Parish and contracted with Associated Pump & Supply to provide bypass pumping operations. The plaintiff alleges under the subcontract the defendants were to provide pumping equipment that fulfills obligations provided by the U.S. Army Corps of Engineers. Merrick Construction asserts that the U.S. Army Corps of Engineers indicated that the bypass pumping equipment installed by Associated Pump & Supply was inspected and received approval on Aug. 10, 2011.
The plaintiff claims just 13 months later the U.S. Army Corps of Engineers ordered the temporary pumps installed by Associated Pump & Supply to be removed. The plaintiff claims that following the completion of the subcontract the defendant submitted an invoice for 14 months worth of service rather than the 13 months of actual service provided.
The defendant is accused of breach of contract and unjust enrichment.
An unspecified amount in damages is sought for the return of all additional amounts the defendant received from the plaintiff.
