Popeyes sued by employee in non-work related slip and fall

GRETNA – A fast food worker is suing her employer claiming she sustained permanent injuries in a fall when she was a customer at the restaurant.

Glenda Collura filed suit against Popeyes Louisiana Kitchen Inc. and Liberty Mutual Insurance Company in the 24th Judicial District Court on April 21.

Collura claims that on June 20, 2013 she visited the Popeyes located at 3444 Willaims Blvd. in Kenner, where she was also employed, to pick up food. The plaintiff alleges that rain water had accumulated on the floor making it dangerous to walk on and that as she entered the establishment she stepped off the entrance mat onto the ceramic floor when she slipped and fell. Collura asserts that she received severe and disabling injuries in the fall, including a fractured and dislocated arm.

The defendant is accused of failing to properly consider the extent of danger with wet greasy floors, failing to inspect the entrance of its store, failing to ensure the ground surfaces were free from slippery substances, failing to warn others or safeguard the walkway, failing to exercise the reasonable care expected of store employees, failing to take action to clean oily substances from an entrance and failing to adequately maintain the floors.

An unspecified amount in damages is sought for loss of quality of life, physical pain and suffering, mental pain and suffering, medical expenses and rehabilitation expenses.

The case has been assigned to Division H Judge Glenn B. Ansardi.
