GRETNA – A local supermarket is being sued by a woman who claims she was severely injured when she broke her hip in a fall over a pallet.
Mary Honoree filed suit against Breaux Mart Supermarkets Inc. and Travelers Insurance Company in the 24th Judicial District Court on May 21.
Honoree alleges that on May 26, 2013 she was shopping at the Breaux Mart when she approached a display to pick up fruit and when she turned to give the fruit to her husband her foot was caught in a wooden pallet and she fell to the floor. The plaintiff asserts she broke her right hip in the incident and was rushed to the hospital in an ambulance.
The defendant is accused of failing to properly construct a display, failing to set up a display that protects against feet sliding beneath supports, failing to take into account the habits and conduct of patrons, failing to protect patrons while on store premises and failing to properly design a display.
An unspecified amount in damages is sought for physical pain and suffering and permanent disability.
Honoree is represented by Gerald P. Webre of Metairie-based Webre Law Firm APLC.
The case has been assigned to Division B Judge Cornelius E. Regan.
Case no. 738-692.
