Wal-Mart sued by woman allegedly injured in fall on slick floor

GRETNA – A corporate retailer is being sued by a woman who claims she was injured after slipping and falling on a slick spot.

Kathy Pierce filed suit against Wal-Mart Stores Inc. in the 24th Judicial District Court on May 23.

Pierce claims on May 31, 2013 she was shopping at the Wal-Mart located at the corner of Loyola and West Esplanade in Kenner and was walking through the automotive section when she slipped on an extremely slick spot and fell to the floor. The plaintiff alleges the floor was slick because the defendant’s employees improperly buffed and cleaned the floor and that when she reported the incident to the store manager he said the floor had been “overbuffed.” Pierce asserts she severely injured her knee in the incident.

The defendant is accused of overbuffing the floor, using inappropriate wax on this floor, failing to properly train its personnel train its personnel in its proper maintenance, failing to warn and failing to maintain a premises free from and safe from hazards.

An unspecified amount in damages is sought for pain and suffering, mental anguish, lost wages, loss of earnings capacity and medical expenses.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
