Mountain bike rider allegedly run over by box truck sues

GRETNA – A man who claims he was run over by a box truck while riding his mountain bike is suing.

Joseph Johnson Jr. filed suit against LM Insurance Corporation, Todd L. Hunter and Atlantic Premium Brand Ltd. in the 24th Judicial District Court on June 2.

Johnson alleges on June 18, 2013 he was riding his mountain bike at 455 31st St. in Kenner when a 2012 International Dura Star box truck operated by Hunter crashed into him. The plaintiff claims that he received severe and disabling injuries in the incident.

The defendant is accused of operating a motor vehicle with a wanton and reckless disregard for safety of others, operating a motor vehicle in a manner to endanger others, failing to stop, failing to see what should have been seen and failing to avoid the accident.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, inconvenience, mental anguish and medical bills.

Johnson is represented by attorney James B. Guest of Kenner.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.

Case no. 739-021.
