NEW ORLEANS – A worker who allegedly contracted mesothelioma is suing multiple corporations claiming their negligence in exposing him to asbestos led to his contraction of the disease.
James Capdeboscq filed suit against Asbestos Corporation Limited, Burmaster land and Development Co. LLC, CBS Corporation, Crane Co., Eagle INC., Georgia-Pacific LLC, Home Insurance Co., Hopeman Brothers INC., Houston General Insurance Co., International Paper Co., Liberty Mutual Insurance Co., McCarty Corp., Maryland Casualty Co., Metropolitan Life Insurance Co., Reilly-Benton Co., Taylor-Seidenbach INC., Union Carbide Corp., Uniroyal INC., Zurich American Insurance Co., Avondale Industries Inc. f/k/a Northrop Grumman Ship Systems Inc., Albert Bossier, Certain Underwriters at Lloyd’s London, Highlands Insurance Co., Onebeacon Insurance Co., and The Travelers Insurance Co. in the Orleans Parish Civil District Court on May 6.
The plaintiff claims he was led to believe that working around asbestos was not harmful, and he was required to handle it as part of his job as an engineering clerk at the Avondale Shipyard in Bridge City. The plaintiff claims the defendants knew or should have known of the harmful effects of asbestos products. The plaintiff asserts the defendants ignored or actively concealed information about the hazards of working with asbestos. The plaintiff claims to have contracted malignant mesothelioma, an incurable and terminal cancer, due to his exposure to asbestos.
The defendants are accused of failing to provide a safe place to work, failing to provide adequate measures to control the level of exposure to asbestos and failing to inform the plaintiff of the hazards of asbestos exposure.
The plaintiff is seeking an unknown amount in damages for medical expenses, lost earnings, mental suffering, loss of quality of life and disability.
