Motorist sued by LaDOTD for allegedly damaging traffic control box in accident

GRETNA – The Louisiana Department of Transportation and Development is suing a driver who allegedly damaged a traffic box in a car accident.

The State of Louisiana through the Louisiana Department of Transportation and Development filed suit against Osman Matute, Kelvin Lopez and John Doe in the 24th Judicial District Court on June 13.

The plaintiff claims that on June 22, 2013 Lopez was driving a 2000 Nissan Altima owned by Matute when he attempted to pass another vehicle at a high rate of speed and lost control of the vehicle and crashed into a traffic box owned by the Louisiana Department of Transportation and Development. According to the lawsuit, Lopez was cited for reckless operation of a motor vehicle and hit and run driving in the incident.

The defendant is accused of failing to maintain control of the vehicle, failing to take proper evasive action, failing to apply the brakes in time to avoid the accident, operating he vehicle in a generally careless and reckless manner.

An unspecified amount in damages is sought for property damage.

The plaintiff is represented by Assistant Attorney General J. Andrew Murrell of the Louisiana Department of Justice.

The case has been assigned to Division O Judge Ross P. LaDart.
