GRETNA – A property insurer is being sued for allegedly not covering a customer’s damage following Hurricane Isaac.
Gregory Hicks and Jeanette Goodwin filed suit against Access Home Insurance Company and Bankers Specialty Insurance Company in the 24th Judicial District Court on June 17.
Hicks and Goodwin contend their home was severely damaged when it was struck by heavy wind and rain on Aug. 29, 2012. The plaintiffs assert that due to the hurricane the interior of their home was damaged resulting in it being contaminated by mold. Hicks and Goodwin allege that during the hurricane they had a homeowners’ insurance policy in effect by Bankers Specialty Insurance Company. However, the plaintiffs contend the defendants found their damages were caused by a construction defect rather than the storm and denied the insurance claim.
Hicks and Goodwin allege their damages should have been covered by the insurer.
The defendant is accused of breach of contract, failing to investigate the claim thoroughly, failing to pay the claim despite obvious damage and failing to act reasonably and in good faith.
An unspecified amount in damages is sought for full insurance coverage, penalties provide under state law and attorney’s fees.

The case has been assigned to Division B Judge Cornelius E. Regan.
